Freshbedynky is a limited company Fresh For Life s.r.o., of Filip Riha and Veronika Mouchova. We provide a service with love and compliant with law. Our business terms correspond to the nature of the goods sold and the joy we share with our customers. We will never harm a customer and we will not die for a customer either. :-) 1-1 Our address is Na Neklance 28, Praha 5. Tax number is CZ24829544. For contact details, see "Contact" section. 1-2 We run the webpages www.freshbedynky.cz and an internet application bedynky.insert.cz (="page") 1-3 These business terms establish relationship between us - sellers - and you - customers for shopping in the eshop Freshbedynky. Together with your order, the business terms form a purchase contract from the moment of placing your order. 1-4 If there are any issues not defined in this document, the relationship is formed by CZ laws No. 40/1964 Sb., and No. 634 / 1992 Sb. 1-5 If we change the business terms, we will warn you at our page so that you can see the changes before you place your order. Placing an order 2-1 In our eshop, you are buying a "freshbox". Freshbox is a mixture of fruits, veggies and further goods. You can select the contents of the box yourself or let us select it for you. We treat the freshbox as goods itself. It is a subject of packing, delivery and invoicing. 2-2 Select your preferred goods from our order, fill in the order form and click to send your order. Prior to sending the order you can always check the contents and price of your freshbox and change the contents. Purchaser is to be over 18 years old and is required to fill in true and complete data that he is asked for in the order form. 2-3 After sending the order through our page, you will receive from us an email confirmation. 2-4 Organic quality of your freshbox is guaranteed with organic certificates of our farmers and vendors. Unavailability of goods 3-1 Fresh fruits and veggies are delivered by a number of farmers and our foreign partners. We do not bear responsibility for unexpected circumstances and for the will of the nature that might change the availability of goods. If such a thing occurs we will inform you and will offer to you a substitute item for your order. Price of the goods 4-1 For each of the item, you can see price for the specified amount of the goods (kg, g, liter, bunch, pc). Price for delivery is listed separately. Price of entire shopping is confirmed priori to placing of your order in the order form. 4-2 Prior to placing an order you are required to agree with accepting and paying for the ordered goods. 4-3 Purchasing price is to be paid at the delivery in cash. For regular customers, we wire transfer option upon individual agreement. 4-4 We provide you with a legal tax invoice with items of all delivered goods and of the delivery fee. 4-5 For each order, there is a CZK50 add-on as a box deposit. If you are returning your box from prior order, CZK50 will be subtracted from your invoice for each box returned, at the delivery. 4-6 In your order confirmation, you will see an estimated price for your order. Final price is subject to change due to availability of goods ordered, final amounts of goods (as in a supermarket, we weight the goods so you pay exactly for what you get), and discounts that we subtract from the price when we process it. You will learn the final price at the delivery. Delivery 5-1 We deliver the goods only in the area of Prague city and 10kms from its borders, to the delivery address in the order. We deliver selected goods by PPL service to the entire Czech Republic, for orders above CZK3000. 5-2 Delivered goods is handed over to the person named in the order, in the time range specified in the order. If the person is not available, the order can be handed over to their relatives or neighbours who are willing to accept the goods. If there is nobody present at the delivery time, we will contact you to arrange a second delivery. Goods is perishable so we recommend to arrange it quickly. The second delivery will be added to the invoice. In case of pick up of a box at one of our delivery points, the customer is responsible for being present there at the pre-arranged delivery time. The final time details are sent to you in a morning "delivery" SMS on the day of delivery. If the first delivery attempt is not successful, we can not guarantee freshness of the goods ordered. 5-3 We do everything possible to deliver goods at exact time. Though, due to unexpected circumstances we might be late sometimes. We will contact you in such a case and re-arrange the delivery. 100% warranty 6-1 If there is any goods missing or damaged, you will send us an email message within 24 hours of delivery with a description of the problem. 6-2 For an accepted claim, we will be happy to compensate you in your next order, transfer money to your account or in urgent cases send you substitute goods immediately. 6-3 Warranty claims are part of the nature of the goods. We ask you to tell us about any troubles you might have with the deliver, and please, with a smile. We are here to re-connect you with the nature. Cancelling the purchasing contract 7-1 Due to perishability of the goods, it is not allowed to cancel the contract. 7-2 If you cancel the contract anyway, you are liable to find another buyer for your order. If not, you will pay us 100% of your order price. For regular customers, the cancellation fee is 65% of the order price. Registration at our page 8-1 If you are 18 years ando lder, you can register at our eshop. Please enter only true and complete information. 8-2 Your login and password is accessible for you only, please keep it secure (e.g. when ordering from an unknown computer). You are responsible for abuse of your login and password. 8-3 If you forget your password, we will be happy to send it to your registered email. We do not tell password over phone or send to not registered emails. 8-4 We have the right to cancel your registration. Internet connection 9-1 The Internet is a non-stable medium which we do not guarantee. We are not responsible for the connection between you and our page. 9-2 We have the right to restrict access to our page due to internal reasons. Information on the page 10-1 We keep at our page updated information on the goods, esp. names, price and amount. We also describe nature of the goods and sometimes its usage. This information is for informational purposes only and we are not responsible for the way you treat the goods. 10-2 If you find any mistakes or errors at our page, please let us know! Intangible property 11-1 All the content of the page is owned by Filip Riha and can not be used without written agreement of Filip Riha. 11-2 Linking the page at third party pages is allowed only after prior agreement of Filip Riha. Collection and securing personal details 12-1 We collect your details in order to provide you with our service. We dont give your details to any third parties except for our delivery contractors. 12-2 Thanks to the nature of our business, we send to our customers a regular email newsletter with seasonal changes in our offer, current recipes and latest news from our farmers. You can easily cancel your subscription at the bottom of the newsletter. 12-3 You can always change or delete your personal details in your personal section in our page. Final conditions 13-1 Together with your order, these conditions constitue a valid purchasing contract. If any part of the purchasing contract becomes invalid, all the other parts keep valid. 13-2 The contract is valid under Czech law.
